Overall responses from full and thorough jurisdictions based on the current situation in Hong Kong and public consultation led by the Pharmacy and Poisons Board of Hong Kong (the Board), the Department of Hong Kong (DH) confirmed that the Board decided to endorse the regulation of medical gases as pharmaceutical products under the Pharmacy and Poisons Ordinance (Cap.138) effectively from 14 June 2026.
The Board agreed to provide a 2-year transition period, starting from 14 June 2024 until 13 June 2026, to facilitate the industry, manufacturers, stakeholders, and responsible persons in preparing documentation and making applications for relevant licenses and registration of their products.
Following the new regulation enforcement, the medical gases are required to be legally registered with the Board before their market placement in Hong Kong. Guidance notes are available on the Board’s website.
